I was lead to believe that Mr. Deragon was ineligible to stay in his seat, despite not believing word one of his intentions to "spend more time with his family."  And though I mentioned on several occasions that I didn't think he was smart enough to find a way to trick anyone into staying onboard, unless there was subterfuge involved, I was absolutely flummoxed when he was voted on for another six months.

Hmmm... so I'm obviously not in the loop any more.  Why was there a vote? and why is it thru November?  Is he still in his 'appointed' position?  It seems like he's been in there long enough to go thru an election round.

Way to go Councilman D^2.  That's what I voted for you for.  Now, let's get that petition started up to get rid of that evil liquor!

Deragon's seat was up for election this year.  He was running against Jeff Caponera.  Early on, Deragon dropped out, saying that he wanted to spend more time with his family.

Later, Caponera accepted a job at a Sgt. for the Anna PD. 

Since he can't serve and be employed by the city, he dropped out also.

Effectively, nobody ran for the seat.

The council was presented with two options toninght for dealing with the empty seat:  Appoint someone to fill the position or call for a special election in Nov. for seat 6.

For reasons as yet unknown, Billy gets to keep the seat despite the fact that he was not running for it.

In my opinion (which admittedly isn't always the same as our legislators) the seat should remain vacant until the results of the Nov. election are canvassed.

Drax, that was not an option posed to Council this evening.  The City Attorney gave three options: 1) to appoint someone and they would have taken seat tonight 2) to vote to allow for a special election in Nov or May 2009 3) take no action. 

It seems that in light of all that HAS gone on with that seat it was only right for the citizens to get a chance to vote.  I know I prefer a chance to vote as apposed to not having that opportunity.

First let me say I agree with the thinking that Councilmen Deragon should not have just retained his seat. But that is the way the Charter deals with this event. Councilmen Green asked that question, and it was brought to light there was no option for the council to vote on, that would  include leaving the seat unfilled. So when I casted my vote it was not for him to retain his seat,but for you the citizenry to have a voice and be able to vote and fill the seat. So now I  look forward to citizens stepping forward and showing interest in serving.

First of all, congrats to Jeff.  He's my pug neighbor.  I didn't realize that's why he dropped out.

Now, to the former concern.  If Councilman D didn't want to serve, then he can't be forced to serve.  His term has expired.  I think Clark needs to get that straightened out pretty quick before they start including his votes on issues.  They may end up with a bunch of contested votes that end up in court...

Per the Charter:

The Mayor and each Council Member are elected at large, and unless sooner removed under the provisions of this Charter, serve for a term of two years, and until their successor has been elected and duly qualified.

He was not forced but had the option of resignation which he declined, he felt strongly about leaving the council short a vote, and wanted to participate in finding a replacement.

The council, I believe, was caught in a pickle.  Because the charter does not exactly specify this situation, Billy still has the seat.  Who else to appoint but John Hendricks, if you believe in people running.  Perhaps we are better off knowing that Billy plans on running for School Board next year and has no plans to run in his seat this November.  Anyone interested?   Remember this - ONLY A SITH DEALS IN ABSOLUTES!  Perhaps we need a sith.

Deragon's "concerns" for our City have done enough damage already...and now he gets to stay a little longer?!   OK, let me understand this...his attempt to get rid of some of our city businesses (liquor stores) wasn't enough, his participation in the whole embarrassing Anna Chamber mess wasn't enough, his direct involvement with me being forced to leave the Anna PD wasn't enough, along with other issues that are hardly secret anymore...what does it take for the citizens to tire of this type of leadership?? 

Before the attacks begin, many of you know first-hand that I considered this man to be my close friend, and often defended him and his stance on liquor publicly while many wanted nothing less than a public lynching.  I believed, at that time, that his intentions were as he told me they were - to do what he was elected to do and represent citizens, including some that opposed alcohol sales.  I did not agree with his views, but respected someone willing to stand up and fight for their beliefs.

However, I learned the hard way that this man is not the friend, nor man of character, that I believed him to be...   With him out of the race, and Jeff running unopposed, we were finally going in the right direction.  But that was not to be - instead of being in a position to ask the right questions and raise the issues that need to be addressed, Jeff's voice was silenced when he was recruited to become a city employee, and when that happened, guess who got to keep their seat on the Council...   Many said this wouldn't happen - Well, I believe that the key role players were underestimated and they knew EXACTLY what the options were going to be tonight...and knew what the results would be before the meeting was ever called to order.  Personally, taking no action tonight and having the council agree on someone to fill the seat may have been a better course...who that person would be and whether the council could agree or not is another post for another time...

There are many people that view and post on this forum, but less than 300 people actually showed up to the polls.  And having attended MANY city council meetings, I've seen very few people actually get up and speak during the Public Forum portion of the meetings...  Do we just not care?  Are we too busy to get involved?  Or are we all just so conditioned to accept poor leadership that we don't expect anything else...

And voluntarily give up his base of power?   Unlikely.  I get tired of fighting things he feels strongly about.  But I understand where he's coming from, as I feel strongly about a few things too:  LIKE NOT KEEPING HIM THERE UNTIL NOVEMBER!

I'm one of the few that 8202 mentioned that didn't think he was smart enough to manipulate the council into keeping him on.  And while I still don't credit him with an overabundance of smarts, I'm beginning to question a council which could be so easily manipulated.
