Homeowners Association Issues and concerns

I currently live in the South Fort Worth area, and my problem is that my HOA does not listen to the residents. Last year (February 2010) when we first moved in, we had two trees in our front yard. First of all, these trees were too close to the foundation and when I was going to move them, they were diseased. I removed them and didn't plant anything in my yard. Then came December 24, 2010, and we received a letter dictating that we must plant trees in our yard or face a penalty. Here it was, well over 9 months, and that was the first tree in the yard! Our HOA didn't want to hear our complaints, just said either plant the trees or pay $50.00 every two weeks until we placed a tree in our yard.

Second is that our neighborhood residents, most of them don't even cut their grass. I didn't cut my grass for two weeks, and was fined $25.00, but my neighbors didn't!

Third, we aren't suppose to have farm animals in our development, but some residents have goats, chickens, and mules in their yard. According to the HOA manual (that 65% of residents didn't receive), we aren't suppose to have these type of animals.

Fourth, we are neighboring to another HOA development. Many residents don't pay their HOA dues, and they utilize our pool (that is not regulated). We pay $300.00 a year for a pool that we can't use, the flowers at the front of our development. Our HOA doesn't take none of our phone calls! What I would like to do is find out how we can have our HOA removed and another well respected one that can manage us! We don't have a clubhouse either!

The one thing that really ticks me off is that the development is actually a nice development, but after one year here, the stupid HOA didn't want to help fight with us about a SECTION 8 apartment complex being built less than a mile away from us! This is stupid, and we can't fight anymore! Can someone help us out PLEASE! We IMPLURE YOU FOR YOUR ASSISTANCE!

Do you know any of your neighbors that you can talk with to see if it's only you being singled out? From your tone you make it sound like it's the HOA versus you, and you alone.
If you find anyone there feeling like you do, organize a sub committee of the HOA, then attend meetings as a united bloc. Power in numbers.

Re: the pool, don't you have a lock on the gate that only residents would know the code to?
